TERMS AND CONDITIONS
The following terms and conditions constitute the agreement between you and Where the Wildlings Grow Pty Ltd ACN 616 832 001 trading as The Native School ABN 62 6168 320 01 (The Native School) for the provision of programs and services. By enrolling in or attending any The Native School program or service, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you are under 18, these Terms and Conditions must be agreed to by your parent or legal guardian.
By accepting this agreement on behalf of yourself and for any person under the 18 as the parent or guardian of that child, you:

Acknowledge that you have read and agree to comply with and be bound by:

The Native School non-smoking and zero Drug and Alcohol Policy;

The Native School Code of Conduct;

The Native School Privacy Policy; and

The Native School Cancellation and Pricing Policy.

Represent and warrant that all information provided to The Native School at the time of enrollment and attendance was accurate and complete and not misleading and that you included all information that may impact your or your child/children’s abilities to undertake activities.

Agree as a parent or guardian to supervise your child where The Native School is not responsible for supervision, if attending a parent and child program or for a child under the age of three.

Agree not to endanger yourself or other venue users by acting in an unruly or dangerous manner or by the unsafe or unsupervised use of equipment.

Agree to wear appropriate attire and footwear at all times. Enclosed footwear is to be worn when using tools and around fire.

Agree the care and responsibility of personal property is the responsibility of the owner.

Acknowledge and agree The Native School and their directors, officers, employees, and agents reserve the right to refuse entry or remove people from the premises who do not obey rules and policies, lawful directions of staff, or who create a danger to other venue users.

Acknowledge and agree The Native School and their directors, officers, employees, and agents reserve the right to refuse service to anyone for any reason at any time.

These terms and conditions, together with our code of conduct and policies, shall constitute the entire agreement between you and The Native School in relation to the provision of our services and shall supersede all previous agreements between you and The Native School, communications, and proposals, whether oral or written, including, but not limited to, any prior versions of the terms and conditions.

The Native School may revise these terms and conditions from time to time.

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful or unenforceable, the other provisions will continue in effect. If any unlawful or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Failure of The Native School to exercise or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision.

These terms and conditions shall be governed by and construed in accordance with the laws of the State of California, United States of America.

Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts operating by the laws of the United States of America and in the State of California and any courts entitled to hear appeals from those courts.

Cancellation Policy
We require at least 1 months' notice for cancellation of services. If the cancellation is made with less than 14 days’ notice, a fee may apply. Any deposits paid are non-refundable unless otherwise agreed in writing.
Waiver of Liability

Participation in activities provided by The Native School involves a degree of risk. By participating in or allowing your child to participate in any activities, you agree to release The Native School, its directors, officers, employees, and agents from any liability for personal injury, loss, or damage, to the extent permitted by law.

However, we may use your information in a general sense—without any reference to your name—to create marketing statistics, identify user demands, and assist in meeting customer needs.
